Temporary Resident Permit

If you are not eligible for Visitor Visa or inadmissible in certain situations, you would require Authorization to Return to Canada (ARC) on Temporary Resident Permit in exceptional circumstances.

Hurray! You are now a Citizen of Canada

However, there are laws pertaining to the means of obtaining the citizenship, you may be stripped of your citizenship if found guilty of misrepresentation or fraudulent documentation under the Canadian Citizenship Act.

[ On October 11, 2017, some changes to the Citizenship Act as a result of Bill C-6 became law. Here are some of the changes you need to know about: ]

Physical presence

You must be physically present in Canada for 3 out of the last 5 years with no minimum number of days per year, before applying for citizenship.

Previously

You had to be physically present in Canada for 4 out of 6 years, with a minimum of 183 days in each of the 4 years, before applying for citizenship.

Days spent in Canada before becoming a permanent resident (as a temporary resident or protected person) within 5 years of applying for citizenship, count as ½ days, up to a maximum of 1 year (365 days).

Previously

The time spent in Canada before becoming a permanent resident did not count towards the physical presence requirement for citizenship.

Language and knowledge

If you are between the ages of 18 – 54 years, you must
• Meet language (English or French) requirements
• Take the Citizenship Test

Previously

If you were between 14 and 64 years, you had to meet the language and knowledge requirement for citizenship.

Income Tax

You have to file Canadian income taxes (if required to do so under the Income Tax Act) for 3 out of 5 years, matching the new physical presence requirement.

Previously

You had to file Canadian income taxes, if required to do so under the Income Tax Act, for 4 out of 6 years.

Permanent Residency Obligation

There are residency obligations for maintaining your permanent residency in Canada, if you are a landed immigrant and wish to fulfil the Canada PR obligations.

  • You will be receiving your first PR card after 30 to 90 days of landing as a PR
  • You must show that you are residing at least 2 out 5 years in Canada
  • The PR card is valid for 5 years, and needs to be surrendered if you are eligible and applying for Canadian Citizenship
  • If you lose your PR card while travelling outside of Canada, you may have to obtain a Permanent Resident Travel Document (PRTD) which is not a PR card, The PRTD is only valid to travel into Canada and once you’re back you need to re-apply for a PR card subject to your residency obligations.

Losing your permanent resident status

Permanent resident status may be lost under following circumstances

  1. If an adjudicator determines you are no longer a permanent resident after an inquiry
  2. After a PRTD appeal
  3. You voluntarily renounce your permanent resident status
  4. If a removal order(RO) is made against you and comes into force
  5. If you become a Canadian citizen vide naturalization process

Even if you don’t meet the residency obligation, you would still be a PR until an official decision is made on your status. We offer our services to apply for a new or lost PR card and PRTD as required.

Appeals to Tribunals

We may also assist clients to represent in Immigration Refugee Board to appeal adverse decisions on immigration and refugee protection.
